1. Acceptance of Terms

3. Product Availability & Pricing
All products displayed on our site or in-store are subject to availability. Prices are quoted in East Caribbean Dollars (XCD) unless otherwise stated and may be subject to change without notice.
GBA reserves the right to:
- Limit quantities purchased
- Discontinue any product
- Correct pricing or descriptive errors without liability
4. Order Acceptance & Payment
Placing an order does not constitute a binding contract unless and until:
- Payment is successfully received and confirmed
- GBA issues a formal order confirmation (electronic or printed)
- Product availability is verified
We reserve the right to refuse or cancel any order for reasons including but not limited to:
- Product or service availability
- Errors in product or pricing information
- Suspected fraud or unauthorized transactions
Payment must be made via accepted methods listed on our checkout page or POS terminals. GBA retains title to all goods until full payment is received.
5. Shipping, Delivery & Pickup
Where applicable, delivery and pickup options will be offered. Delivery times are estimates only and are not guaranteed. GBA shall not be held liable for delays due to circumstances beyond our control.
Risk of loss or damage passes to you upon delivery or pickup.
6. Return & Refund Policy
All returns, exchanges, and refunds are governed by our Return & Refund Policy, which forms part of these Terms. By making a purchase, you acknowledge and agree to that policy.
7. Intellectual Property
All content on our website and materials—logos, text, graphics, product images, and digital downloads—are the intellectual property of GBA Enterprises Ltd. or its licensors and are protected by applicable copyright and trademark laws.

12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Commonwealth of Dominica, without regard to conflict of law principles.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dominica.
13. Force Majeure
GBA shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, labor shortages, utility disruptions, pandemics, or governmental actions.
14. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
15. Severability
If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and GBA Enterprises Ltd. relating to the use of our Services and supersede all prior or contemporaneous communications.
